West Bengal Businesses Face
Dual-Layer Compliance Obligations

Business compliance in West Bengal operates on two simultaneous tracks. At the central level, every commercial establishment is subject to the Shops & Establishments framework, FSSAI (for food businesses), and national labour statutes governing provident fund, ESI, and professional tax. At the state level, each municipal body — Howrah Municipal Corporation, Kolkata Municipal Corporation, or local panchayats — has its own Trade Licence framework, fee schedule, and renewal calendar. Missing any single element in either track triggers enforcement cascades: inspectors from one department routinely cross-reference registrations held by other departments, and a lapsed Trade Licence can invalidate bank lending covenants or trigger GST audit flags.

CompliCore Advisory maps every applicable licence and registration for each client business from the moment of engagement. We assess the entity type, number of employees, industry category, location (municipal vs. panchayat jurisdiction), and whether the business handles food, chemicals, or the public — then we build a complete compliance calendar and manage the entire lifecycle: application, renewal, follow-up, and archival. Our clients receive a quarterly compliance health report and are never surprised by an enforcement notice.

Complete Licence Lifecycle Management

Six core service pillars covering every registration and renewal obligation a West Bengal business faces — from inception to annual cycle.

WB Shops & Establishments Act, 2018

Shops & Establishment Compliance

We manage the complete lifecycle under the West Bengal Shops & Establishments Act 2018 — initial registration on the state Labour Department's online portal, annual renewal before the 31 December deadline, maintenance of the mandatory employee register (Form B), display of the certificate at the business premises, and submission of information on working hours, rest intervals, and leave entitlements as required under the Act.

Penalty for Non-Compliance

₹1,000–₹10,000 per violation + potential licence cancellation and closure notice by Labour Department inspector

Municipal Corporation / Panchayat Bodies

Trade Licence Management

Trade Licences are issued annually by municipal corporations (HMC, KMC) or gram panchayats depending on the business location. We track renewal due dates for every client, prepare the application and supporting documents (ownership proof, lease deed, NOC from premises owner), deposit fees through the authorised channel, and ensure physical or digital certificate delivery. For multi-location businesses, we manage each licence independently across jurisdictions.

Penalty for Non-Compliance

Business operations banned + ₹5,000–₹25,000 compounding fine; repeat offenders face permanent licence cancellation

WB Professional Tax Act, 1979

Professional Tax (PT) Enrolment & Returns

Under the West Bengal Profession Tax Act 1979, every employer must obtain an Enrolment Certificate (EC) and deduct Professional Tax from employees earning above ₹10,000 per month. We handle EC registration, employee Enrolment Certificate (RC), monthly deduction as per the WB PT slab (₹110–₹200 per month depending on salary band), monthly challan payment to the WB Commercial Tax Department, and filing of the annual Professional Tax return (Form III or Form V as applicable).

Penalty for Non-Compliance

Interest at 1–2% per month on unpaid Professional Tax + late filing penalty up to ₹1,000; employer personally liable

WB Labour Welfare Fund Act, 1974

Labour Welfare Fund (LWF) Administration

The West Bengal Labour Welfare Fund Act 1974 mandates that employers deduct an employee contribution (₹3 per month) and add the employer's contribution (₹6 per month) for each worker in a covered establishment. We manage the deduction register, compute total liability, and remit contributions to the WB Labour Welfare Board on a half-yearly basis (30 June and 31 December). We also maintain Form A (register of contributions) and Form B (register of fines) as required.

Penalty for Non-Compliance

Fine up to ₹500 per default + interest on delayed remittance; Labour Welfare Inspector can attach employer's accounts

Food Safety & Standards Authority of India

FSSAI Food Licence & Renewal

Any business involved in manufacturing, processing, storing, distributing, or selling food is required to hold an FSSAI licence or registration. We determine the correct licence category (Basic Registration for turnover below ₹12 lakh, State Licence for ₹12 lakh–₹20 crore, Central Licence above ₹20 crore), prepare the application on the FoSCoS portal, coordinate with the Designated Officer, and manage annual renewal. We also guide food safety compliance — display requirements, labelling norms, and record maintenance.

Penalty for Non-Compliance

Fine up to ₹1 lakh + imprisonment up to 6 months under FSS Act 2006; food business closed on spot by Food Safety Officer

WB Fire Services Act & Building Regulations

Fire Safety NOC & Renewals

Commercial and industrial premises above specified built-up areas, as well as any building accessible to the public, require a Fire Safety NOC from the West Bengal Fire & Emergency Services directorate. We prepare the application, compile the fire safety plan and equipment list, coordinate the mandatory site inspection, follow up with the Fire Superintendent's office, and manage the renewal cycle. We also advise on minimum fire safety equipment requirements (extinguishers, hose reels, alarm systems) to clear inspection.

Penalty for Non-Compliance

Business closure notice by Fire Department; building use restricted under WB Fire Services Act; criminal liability under IPC in event of fire incident

How We Manage Your Compliance Lifecycle

A structured five-step engagement model that leaves no licence untracked and no deadline unattended.

1
Document Collection & Mapping

We collect all existing registrations, certificates, and company documents. We map the business against every applicable central and state regulation to build a complete licence inventory.

2
Entity Classification & Licence Applicability Analysis

We classify the establishment by type (shop, manufacturing, food, services), location jurisdiction (HMC/KMC/panchayat), headcount, and industry — then confirm exactly which licences and registrations are legally mandatory.

3
Registration / Renewal Application Submission

We prepare all forms, upload supporting documents on the relevant portal (Labour Dept, Municipal, FoSCoS, WB Fire Services), and submit applications within turnaround timelines. New registrations are typically processed within 3–7 working days.

4
Follow-up & Authority Liaison

We track every pending application, respond to queries or deficiency notices from inspectors, schedule site inspections where required, and liaise directly with municipal and departmental officers to ensure smooth approvals.

5
Certificate Delivery & Calendar Setup

Upon receipt of each certificate, we deliver copies to the client, update the digital compliance calendar, and schedule the next renewal 60 days in advance with automated alerts to the client's designated contact.

Three Reasons Businesses Trust CompliCore With Every Licence

Our systematic process, authority relationships, and institutional knowledge built over three decades of service to West Bengal businesses create a compliance management experience that is proactive, seamless, and reliable.

End-to-End Calendar Management

Every renewal date is tracked in our compliance management system from the moment a client onboards. We automatically initiate the renewal process 60 days before expiry — before the client even remembers it is due. Clients receive milestone updates throughout the process so nothing falls through the cracks, regardless of which municipal body or government department is involved.

Municipal Body Expertise

Working with Howrah Municipal Corporation, Kolkata Municipal Corporation, and panchayat bodies across West Bengal requires knowing the right counter, the right officer, and the right format for each body. Our team has established working relationships with the licencing departments of HMC, KMC Zone I–XVI, and rural panchayat samitis across districts — which translates directly into faster approvals and fewer unnecessary site inspection requests for our clients.

30+ Years, Zero Lapses

Since our founding as Dey Associate in 1994, not a single client has experienced a licence lapse, enforcement closure, or penalty arising from a missed renewal under our management. This is not a marketing claim — it is a product of our systematic pre-expiry process, our authority liaison network, and the institutional knowledge our team has built across three decades of serving businesses in West Bengal.
