What Is EHS Compliance

Three Overlapping Frameworks, One Integrated Obligation

EHS compliance in India spans three overlapping legislative frameworks that every factory and industrial establishment must simultaneously satisfy. The first is Occupational Safety & Health: currently governed by the Factories Act 1948 — transitioning to the OSH Code 2020 — covering the appointment of safety officers, emergency response plans, periodic worker health checks, canteen and restroom welfare, and the constitution of safety committees in establishments with 250 or more workers.

The second framework is Environmental Compliance: every factory must hold a valid Consent to Establish (CTE) and Consent to Operate (CTO) from the West Bengal Pollution Control Board (WBPCB) under the Air (Prevention & Control of Pollution) Act 1981, Water (Prevention & Control of Pollution) Act 1974, and the Environment Protection Act 1986. Stack emission limits, effluent treatment plant (ETP) standards, and trade effluent discharge norms are regularly monitored. WBPCB has been aggressively enforcing — issuing closure directions to non-compliant units across Howrah, Hooghly, and 24-Parganas districts in FY 2024-25.
