The Government of India notified all four Labour Codes on 21 November 2025, replacing 29 existing laws. These codes — Code on Wages, Industrial Relations Code, Social Security Code, and OSH & WC Code — introduce a universal 50% wage rule (Basic + DA must be ≥ 50% of CTC), extend ESIC coverage to all 10+ employee establishments nationwide, mandate social security for gig workers, and entitle fixed-term employees to gratuity after just one year. The Employees' Enrolment Campaign 2025 (EEC 2025) is an amnesty scheme open from 1 November 2025 to 30 April 2026. It allows any employer — whether currently registered with EPFO or not — to voluntarily enrol workers who should have been covered under EPF between 1 July 2017 and 31 October 2025 but were missed. The penalty is a flat ₹100 lump-sum per establishment, the employee share of contribution is waived, and no prosecution action is taken. Even establishments under Section 7A inquiry are eligible. This is a one-time window — missing it could expose you to full back-payment demands with standard penalties after 30 April 2026.
Under the new Code on Wages, wages are now defined as Basic Pay + Dearness Allowance + Retaining Allowance, and this combined figure must constitute at least 50% of the employee's total CTC. If your current salary structure pays a lower basic (a common practice to reduce EPF liability), the excess allowances are now automatically counted as wages for EPF, ESIC, and gratuity calculation purposes. This will typically increase both employee and employer EPF contributions by 2–5% of CTC for affected employees. West Bengal has several state-specific statutory obligations beyond central laws. These include West Bengal Professional Tax (P-Tax) — deductible from employees earning above ₹8,500/month and remittable to the state government; West Bengal Labour Welfare Fund (LWF) — annual contribution required; WB Shops and Commercial Establishment Act registration and renewal; WB Factories Act licence and renewal for manufacturing units; and the WB Contract Labour (R&A) Act compliance for principal employers. Non-compliance during a government inspection can result in a show-cause notice, followed by demand notices for back contributions with interest, and penal damages that can range from 5% to 25% of the dues depending on the delay period. Under the new Labour Codes, first-time offences are compoundable at 50–75% of the maximum fine, but repeat offences within five years cannot be compounded and may attract imprisonment. Yes — and this is a critical area many businesses underestimate. Under the Contract Labour (R&A) Act, the principal employer remains liable for contractor compliance, including EPF, ESIC, minimum wages, and proper maintenance of registers. If your contractor fails to comply, you as the principal employer must make good those defaults. Under the new Labour Codes, the contract labour threshold has increased from 20 to 50 workers, but principal employer liability remains absolute. Fixed-term employees now also receive the same statutory benefits as permanent employees, including gratuity after just one year.
